A BILL TO BE ENTITLED
AN ACT
relating to the purchase of certain used motor vehicles.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  The heading for Chapter 2305, Occupations Code,
is amended to read as follows:
CHAPTER 2305. [RECORDS OF] CERTAIN VEHICLE REPAIRS, SALES, AND
PURCHASES
       SECTION 2.  Subchapter A, Chapter 2305, Occupations Code, is
amended by adding Section 2305.008 to read as follows:
       Sec. 2305.008.  DISCLOSURE OF VEHICLE CONDITION; RIGHT TO
INDEPENDENT INSPECTION. (a) A person engaged in the business of
selling used motor vehicles shall provide a potential purchaser of
a used motor vehicle a complete and detailed statement of the
vehicle's condition. The statement must include a list of any known
problems or defects affecting the vehicle's mechanical system,
tires, brakes, and any other defect that substantially affects the
vehicle's use, value, or safety.
       (b)  A person engaged in the business of selling used motor
vehicles shall permit a potential purchaser of a used motor vehicle
to arrange for the reasonable inspection of the vehicle, including
an inspection to be conducted away from the premises where the
vehicle is offered for sale. This subsection does not prohibit the
seller of the vehicle from imposing reasonable conditions on the
time, place, and manner of the inspection.
       SECTION 3.  This Act takes effect September 1, 2007.
