A BILL TO BE ENTITLED
AN ACT
relating to the establishment of pain management guidelines for
physicians.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter A, Chapter 153, Occupations Code, is
amended by adding Section 153.0041 to read as follows:
       Sec. 153.0041.  PAIN MANAGEMENT GUIDELINES. The board by
rule may establish guidelines for the treatment of severe acute or
chronic pain by a physician. The guidelines shall apply without
regard to a patient's prior or current chemical dependency or
addiction, but may include standards and procedures applicable to
patients with prior or current chemical dependency or addiction.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
