A BILL TO BE ENTITLED
AN ACT
relating to the provision of free lunch and breakfast to all
enrolled students in certain school districts and campuses.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter Z, Chapter 33, Education Code, is
amended by adding Section 33.9011 to read as follows:
       Sec. 33.9011.  OPERATION OF BREAKFAST AND LUNCH PROGRAMS IN
CERTAIN DISTRICTS. (a) In this section, "breakfast and lunch
program" means the national free or reduced-price breakfast and
lunch program established under 42 U.S.C. Section 1751 et seq.
       (b)  If at least 60 percent of the students enrolled in a
school district are eligible to participate in the breakfast and
lunch program, the school district may seek approval to act under
the appropriate special assistance provision of the program that
allows the school district to:
             (1)  offer free breakfast and lunch to all students
enrolled in the district; and
             (2)  reduce administrative costs and requirements
associated with the program.
       (c)  If less than 60 percent of the students enrolled in a
school district are eligible to participate in the breakfast and
lunch program but at least 60 percent of the students enrolled at a
particular district campus are eligible to participate in the
program, the school district may seek approval to act under the
appropriate special assistance provision of the program as provided
by Subsection (b) on behalf of the campus.
       (d)  A school district to which Subsection (b) or (c) applies
may seek approval to act under the appropriate special assistance
provision of the breakfast and lunch program as provided by
Subsection (b) for:
             (1)  breakfast only;
             (2)  lunch only; or
             (3)  breakfast and lunch.
       (e)  A school district that does not have sufficient funds to
provide free breakfast or lunch to all students enrolled in the
district as provided by Subsection (b) or to all students enrolled
at a district campus as provided by Subsection (c) may apply to a
nonprofit organization, governmental entity, or other source for a
grant for that purpose.
       SECTION 2.  This Act applies beginning with the 2007-2008
school year.
       SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
