A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to publishing notice of certain agreements with state |
|
|
agencies in the Texas Register. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter Z, Chapter 2252, Government Code, is |
|
|
amended by adding Section 2252.904 to read as follows: |
|
|
Sec. 2252.904. PUBLICATION IN TEXAS REGISTER BEFORE |
|
|
ENTERING INTO CERTAIN AGREEMENTS. (a) In this section, "state |
|
|
agency" means a department, institution, commission, or other |
|
|
agency of the executive branch of state government, including an |
|
|
institution of higher education as defined by Section 61.003, |
|
|
Education Code. |
|
|
(b) Not later than the 30th day before the date a state |
|
|
agency, without using a public competitive procurement process, |
|
|
enters into an agreement with any private entity under which the |
|
|
private entity will market or further develop a product developed |
|
|
in whole or in part using state-funded research or development, |
|
|
including an agreement in which the state provides something of |
|
|
value to the private entity and receives money or other |
|
|
consideration in return, the state agency shall file with the |
|
|
secretary of state for publication in the Texas Register notice of |
|
|
the agency's intention to enter into the agreement. |
|
|
(c) Notice must include all information necessary for a |
|
|
person to make an offer in relation to the subject of the proposed |
|
|
agreement. |
|
|
SECTION 2. The changes in law made by this Act apply only to |
|
|
a contract or agreement entered into on or after October 1, 2007. A |
|
|
contract or agreement entered into before that date is governed by |
|
|
the law in effect at the time the contract or agreement was entered |
|
|
into, and the former law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2007. |
