A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the application and enforcement of municipal |
|
|
construction codes. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 214.212(b), Local Government Code, is |
|
|
amended to read as follows: |
|
|
(b) The International Residential Code applies to all |
|
|
construction, alteration, remodeling, enlargement, and repair of |
|
|
residential structures in a municipality. Notwithstanding Section |
|
|
242.001, the governing body of a municipality by ordinance may |
|
|
extend to the extraterritorial jurisdiction of the municipality the |
|
|
application of the International Residential Code and any |
|
|
amendments adopted as provided by this section. |
|
|
SECTION 2. Section 212.049, Local Government Code, is |
|
|
repealed. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
