A BILL TO BE ENTITLED
|
|
AN ACT
|
|
|
relating to the date for a consolidation election of two or more |
|
municipalities. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 61.004, Local Government Code, is |
|
amended by amending Subsection (e) and adding Subsection (f) to |
|
read as follows: |
|
(e) In the alternative to the procedures provided in |
|
Subsections (a)-(d), the governing body of each municipality |
|
holding a consolidation election may order the election to be held |
|
on the same election date. |
|
(f) A consolidation election shall be held on the first |
|
authorized uniform election date prescribed by the Election Code |
|
that occurs [on or] after the period required by Section 3.005, |
|
Election Code [30th day after the date the election is ordered]. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
