A BILL TO BE ENTITLED
AN ACT
relating to the establishment of a task force to assist certain
long-term care facilities in developing the capacity to provide
services to individuals with disabilities through community-based
arrangements.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter B, Chapter 531, Government Code, is
amended by adding Section 531.02443 to read as follows:
       Sec. 531.02443. TASK FORCE ON ASSISTING LONG-TERM CARE
FACILITIES WITH TRANSITIONING TO COMMUNITY-BASED SERVICE MODELS.
(a) The executive commissioner shall establish a task force to
assist long-term care facilities that provide care to individuals
with disabilities in developing the capacity to transition from
providing facility-based long-term care services to providing
community-based services.
       (b)  The executive commissioner shall determine the number
of members of the task force. The executive commissioner shall
appoint as members of the task force:
             (1)  representatives of providers of residential
long-term care services to individuals with disabilities;
             (2)  representatives of providers of community-based
services to individuals with disabilities;
             (3)  representatives of appropriate health and human
services agencies;
             (4)  representatives of advocacy groups for
individuals with disabilities;
             (5)  representatives of advocacy groups for children
with disabilities;
             (6)  at least one representative of the Promoting
Independence Advisory Committee established by the executive
commissioner; and
             (7)  at least one representative of the Children's
Policy Council created under Section 22.035, Human Resources Code.
       (c)  The task force shall:
             (1)  develop a plan designed to assist providers of
residential long-term care services to individuals with
disabilities with the transition from facility-based services to
community-based services; and
             (2)  advise the commission and appropriate health and
human services agencies, stakeholders, and providers of
residential long-term care services to individuals with
disabilities with respect to the plan developed under Subdivision
(1).
       (d)  Not later than September 1 of each year, the task force
shall submit a report to the executive commissioner on the results
of the task force's activities required by Subsection (c).
       (e)  This section expires September 1, 2013.
       SECTION 2.  This Act takes effect September 1, 2007.
