A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the enforcement of unpaid child support. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 157.005(b), Family Code, is amended to |
|
read as follows: |
|
(b) The court retains jurisdiction to confirm the total |
|
amount of child support arrearages and render judgment for past-due |
|
child support if a motion for enforcement requesting a money |
|
judgment is filed not later than the 20th [10th] anniversary after |
|
the date: |
|
(1) the child becomes an adult; or |
|
(2) on which the child support obligation terminates |
|
under the child support order or by operation of law. |
|
SECTION 2. Section 232.006, Family Code, is amended by |
|
amending Subsection (b) and adding Subsection (b-1) to read as |
|
follows: |
|
(b) Except as provided by Subsection (b-1), notice [Notice] |
|
under this section may be served as in civil cases generally. |
|
(b-1) If the individual has been ordered under Chapter 105 |
|
to provide the court and the state case registry with the |
|
individual's current mailing address, notice under this section may |
|
be served by mailing a copy of the petition, by first-class mail, to |
|
the last mailing address of the individual on file with the court |
|
and the state case registry. |
|
SECTION 3. The change in law made by this Act applies to |
|
child support arrearages regardless of the date: |
|
(1) the child support became due; or |
|
(2) the child support obligation terminated. |
|
SECTION 4. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
