A BILL TO BE ENTITLED
AN ACT
relating to the effect of changes in high school enrollment on the
eligibility of a graduating high school student for automatic
admission to a general academic teaching institution.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter U, Chapter 51, Education Code, is
amended by adding Section 51.806 to read as follows:
       Sec. 51.806.  DETERMINATION OF GRADUATING CLASS
ENROLLMENT.  The total enrollment of a student's high school
graduating class for the purpose of determining whether the student
graduated with a grade point average in the applicable percent of
the student's high school graduating class under this subchapter is
the greater of:
             (1)  the total number of students enrolled in the high
school's junior class on October 1 of the student's junior year; or
             (2)  the total number of students enrolled in the
student's high school class on the last school day of the most
recent semester in which the student was enrolled in the high school
and that preceded the application deadline of the general academic
institution to which the student is applying.
       SECTION 2.  The changes in law made by this Act apply
beginning with admissions to an institution of higher education for
the 2008-2009 academic year. Admissions to an academic year before
that academic year are governed by the law in effect before the
effective date of this Act, and the former law is continued in
effect for that purpose.
       SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
