A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
relating to the presence of a teacher during the search of a student |
|
|
at a public school. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter C, Chapter 37, Education Code, is |
|
|
amended by adding Section 37.085 to read as follows: |
|
|
Sec. 37.085. SEARCH OF STUDENT. A school official or peace |
|
|
officer may not conduct a search of a student or the student's |
|
|
property or locker, on school property or while the student is |
|
|
attending a school-sponsored or school-related activity on or off |
|
|
of school property, unless the teacher of a course in which the |
|
|
student is enrolled is present during the search. |
|
|
SECTION 2. This Act takes effect September 1, 2007. |
