A BILL TO BE ENTITLED
AN ACT
relating to the purchase of plug-in hybrid electric vehicles by
state agencies.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter A, Chapter 2158, Government Code, is
amended by adding Section 2158.009 to read as follows:
       Sec. 2158.009.  PURCHASE OF PLUG-IN HYBRID  ELECTRIC
VEHICLES.  (a)  In this section, "plug-in hybrid electric vehicle" 
means a vehicle that is powered by both:
             (1)  an internal combustion engine; and
             (2)  an electric motor supplied by batteries that can
be charged from an external electrical outlet.
       (b)  Notwithstanding Section 2158.004 or 2158.005 or any
other law, a state agency may not purchase a vehicle unless the
vehicle is a plug-in hybrid electric vehicle.
       (c)  Subsection (b) does not apply if the state agency
determines that the cost over a five-year period to purchase and
operate a plug-in hybrid electric vehicle of the type required by
the agency is greater than the cost over a five-year period to
purchase and operate a similar vehicle that is not a plug-in hybrid
electric vehicle.
       SECTION 2.  The heading to Subchapter A, Chapter 2158,
Government Code, is amended to read as follows:
SUBCHAPTER A.  PURCHASE OF [PASSENGER] VEHICLES
       SECTION 3.  This Act takes effect September 1, 2007.
