A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the purchase of plug-in hybrid electric vehicles by |
|
|
state agencies. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 2158, Government Code, is |
|
|
amended by adding Section 2158.009 to read as follows: |
|
|
Sec. 2158.009. PURCHASE OF PLUG-IN HYBRID ELECTRIC |
|
|
VEHICLES. (a) In this section, "plug-in hybrid electric vehicle" |
|
|
means a vehicle that is powered by both: |
|
|
(1) an internal combustion engine; and |
|
|
(2) an electric motor supplied by batteries that can |
|
|
be charged from an external electrical outlet. |
|
|
(b) Notwithstanding Section 2158.004 or 2158.005 or any |
|
|
other law, a state agency may not purchase a vehicle unless the |
|
|
vehicle is a plug-in hybrid electric vehicle. |
|
|
(c) Subsection (b) does not apply if the state agency |
|
|
determines that the cost over a five-year period to purchase and |
|
|
operate a plug-in hybrid electric vehicle of the type required by |
|
|
the agency is greater than the cost over a five-year period to |
|
|
purchase and operate a similar vehicle that is not a plug-in hybrid |
|
|
electric vehicle. |

|
SECTION 2. The heading to Subchapter A, Chapter 2158, |
|
|
Government Code, is amended to read as follows: |
|
|
SUBCHAPTER A. PURCHASE OF [PASSENGER] VEHICLES |
|
|
SECTION 3. This Act takes effect September 1, 2007. |
