A BILL TO BE ENTITLED
AN ACT
relating to excepting the birth date of a governmental official or
employee and certain other information that could be used for the
purpose of identity theft from required disclosure under the public
information law.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter C, Chapter 552, Government Code, is
amended by adding Section 552.148 to read as follows:
       Sec. 552.148.  EXCEPTION: BIRTH DATE AND OTHER IDENTIFYING
INFORMATION OF GOVERNMENTAL OFFICIAL OR EMPLOYEE.  (a)  This
section does not apply to information described by Section
552.117(a).
       (b)  The birth date of a current or former official or
employee of a governmental body and any other information about
such a person that in reasonable probability could be used for the
purpose of identity theft is excepted from the requirements of
Section 552.021.
       (c)  A governmental body may redact the birth date of a
current or former official or employee of the governmental body
from any information the governmental body discloses under Section
552.021 without the necessity of requesting a decision from the
attorney general under Subchapter G.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
