A BILL TO BE ENTITLED
AN ACT
relating to the confidentiality of certain identification
information of a child in a suit affecting the parent-child
relationship.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Chapter 108, Family Code, is amended by adding
Section 108.111 to read as follows:
       Sec. 108.111.  CONFIDENTIALITY OF CHILD'S IDENTIFICATION
INFORMATION.  (a)  Notwithstanding any other provision in this
title, information specifically identifying a child in a suit
affecting the parent-child relationship, including the child's
social security number, driver's license number, or number of a
personal identification card issued by the Department of Public
Safety, contained in an order, petition, motion, report, or other
document required in this title, is confidential and does not
constitute public information for purposes of Chapter 552,
Government Code.
       (b)  A court, the Title IV-D agency, or any other person that
maintains a document described by Subsection (a) containing
information that is confidential under this section shall ensure
that the information is excluded from disclosure.
       (c)  This section does not apply to the disclosure of
information between the parties in a suit or to a disclosure to a
court, the Title IV-D agency, or another person entitled under this
title to receive the information as long as the disclosure is
otherwise permitted by law.
       SECTION 2.  The change in law made by this Act applies to
information contained in an order, petition, motion, report, or
other document required under Title 5, Family Code, regardless of
the date the document was created.
       SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
