A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the confidentiality of certain identification |
|
information of a child in a suit affecting the parent-child |
|
relationship. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 108, Family Code, is amended by adding |
|
Section 108.111 to read as follows: |
|
Sec. 108.111. CONFIDENTIALITY OF CHILD'S IDENTIFICATION |
|
INFORMATION. (a) Notwithstanding any other provision in this |
|
title, information specifically identifying a child in a suit |
|
affecting the parent-child relationship, including the child's |
|
social security number, driver's license number, or number of a |
|
personal identification card issued by the Department of Public |
|
Safety, contained in an order, petition, motion, report, or other |
|
document required in this title, is confidential and does not |
|
constitute public information for purposes of Chapter 552, |
|
Government Code. |
|
(b) A court, the Title IV-D agency, or any other person that |
|
maintains a document described by Subsection (a) containing |
|
information that is confidential under this section shall ensure |
|
that the information is excluded from disclosure. |
|
(c) This section does not apply to the disclosure of |
|
information between the parties in a suit or to a disclosure to a |
|
court, the Title IV-D agency, or another person entitled under this |
|
title to receive the information as long as the disclosure is |
|
otherwise permitted by law. |
|
SECTION 2. The change in law made by this Act applies to |
|
information contained in an order, petition, motion, report, or |
|
other document required under Title 5, Family Code, regardless of |
|
the date the document was created. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
