A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to suspending a public school student from participating |
|
in extracurricular activities under certain circumstances. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter D, Chapter 33, Education Code, is |
|
amended by adding Section 33.0813 to read as follows: |
|
Sec. 33.0813. SUSPENSION FROM PARTICIPATION IN |
|
EXTRACURRICULAR ACTIVITIES UNDER CERTAIN CIRCUMSTANCES. (a) A |
|
student who is convicted of a Class C misdemeanor or is found to |
|
have engaged in conduct indicating a need for supervision under |
|
Section 51.03(b)(1)(A), Family Code, shall be suspended from |
|
participating in any extracurricular activity sponsored or |
|
sanctioned by a school district or the University Interscholastic |
|
League for two consecutive weeks during the 30-day period |
|
immediately following the date of the student's conviction or |
|
adjudication. |
|
(b) A student who is charged with an offense punishable by |
|
confinement or who has been referred to juvenile court for |
|
allegedly engaging in delinquent conduct under Section |
|
51.03(a)(1), Family Code, may not participate in any |
|
extracurricular activity sponsored or sanctioned by a school |
|
district or the University Interscholastic League during the |
|
duration of the criminal or juvenile court proceeding. The |
|
suspension of a student imposed under this subsection: |
|
(1) shall be immediately removed if the student is |
|
found not guilty of the offense charged or found not to have engaged |
|
in delinquent conduct; and |
|
(2) shall be imposed permanently if the student is |
|
convicted of the offense charged or found to have engaged in |
|
delinquent conduct. |
|
SECTION 2. (a) The change in law made by this Act applies |
|
only to an offense committed or conduct that occurs on or after the |
|
effective date of this Act. For purposes of this section, an |
|
offense is committed or conduct occurs before the effective date of |
|
this Act if any element of the offense or conduct occurs before that |
|
date. |
|
(b) An offense committed or conduct that occurs before the |
|
effective date of this Act is covered by the law in effect when the |
|
offense was committed or the conduct occurred, and the former law is |
|
continued in effect for that purpose. |
|
SECTION 3. This Act takes effect September 1, 2007. |
