A BILL TO BE ENTITLED
AN ACT
relating to suspending a public school student from participating
in extracurricular activities under certain circumstances.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter D, Chapter 33, Education Code, is
amended by adding Section 33.0813 to read as follows:
       Sec. 33.0813.  SUSPENSION FROM PARTICIPATION IN
EXTRACURRICULAR ACTIVITIES UNDER CERTAIN CIRCUMSTANCES.  (a) A
student who is convicted of a Class C misdemeanor or is found to
have engaged in conduct indicating a need for supervision under
Section 51.03(b)(1)(A), Family Code, shall be suspended from
participating in any extracurricular activity sponsored or
sanctioned by a school district or the University Interscholastic
League for two consecutive weeks during the 30-day period
immediately following the date of the student's conviction or
adjudication.
       (b)  A student who is charged with an offense punishable by
confinement or who has been referred to juvenile court for
allegedly engaging in delinquent conduct under Section
51.03(a)(1), Family Code, may not participate in any
extracurricular activity sponsored or sanctioned by a school
district or the University Interscholastic League during the
duration of the criminal or juvenile court proceeding. The
suspension of a student imposed under this subsection:
             (1)  shall be immediately removed if the student is
found not guilty of the offense charged or found not to have engaged
in delinquent conduct; and
             (2)  shall be imposed permanently if the student is
convicted of the offense charged or found to have engaged in
delinquent conduct.
       SECTION 2.  (a) The change in law made by this Act applies
only to an offense committed or conduct that occurs on or after the
effective date of this Act. For purposes of this section, an
offense is committed or conduct occurs before the effective date of
this Act if any element of the offense or conduct occurs before that
date.
       (b)  An offense committed or conduct that occurs before the
effective date of this Act is covered by the law in effect when the
offense was committed or the conduct occurred, and the former law is
continued in effect for that purpose.
       SECTION 3.  This Act takes effect September 1, 2007.
