A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the enforcement of federal immigration and customs laws |
|
by the Department of Public Safety of the State of Texas. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter Z, Chapter 421, Government Code, is |
|
amended by adding Section 421.902 to read as follows: |
|
Sec. 421.902. IMMIGRATION ENFORCEMENT. (a) Subject to |
|
approval by the governor, the public safety director of the |
|
Department of Public Safety of the State of Texas shall enter into |
|
an agreement with the United States Office of the Attorney General |
|
or other appropriate federal agency relating to the state's |
|
enforcement of federal immigration and customs laws in this state, |
|
including detentions, removals, and investigations. |
|
(b) The public safety director of the Department of Public |
|
Safety of the State of Texas shall designate appropriate peace |
|
officers to be trained in accordance with the agreement described |
|
by Subsection (a). A peace officer certified as trained in |
|
accordance with the agreement is authorized to enforce federal |
|
immigration and customs laws within the scope of the officer's |
|
authorized duties. |
|
(c) The Department of Public Safety of the State of Texas |
|
shall ensure that the training described by Subsection (b) is |
|
financed using federal money received under the Department of |
|
Homeland Security Appropriations Act or other federal law. |
|
SECTION 2. This Act takes effect September 1, 2007. |
