A BILL TO BE ENTITLED
AN ACT
relating to filing of personal financial statements by unsalaried
appointed state officers.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter B, Chapter 572, Government Code, is
amended by adding Section 572.0212 to read as follows:
       Sec. 572.0212.  FILING BY UNSALARIED APPOINTED OFFICER NOT
REQUIRED. (a) In this section, "salary" means a salary for state
service, but not a per diem or other form of compensation.
       (b)  An appointed officer, including an appointed officer of
a major state agency, is not required to file a financial statement
if the officer:
             (1)  is not authorized to receive a salary; and
             (2)  does not receive a salary.
       (c)   To be eligible for the exemption under Subsection (b),
the officer must provide written notice that the officer satisfies
the requirements of that subsection to the commission.
       SECTION 2.  Section 572.0212, Government Code, as added by
this Act, applies to a financial statement filed under Subchapter
B, Chapter 572, Government Code, regardless of whether the
statement was required to be filed before, on, or after the
effective date of this Act.
       SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
