A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to filing of personal financial statements by unsalaried |
|
appointed state officers. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter B, Chapter 572, Government Code, is |
|
amended by adding Section 572.0212 to read as follows: |
|
Sec. 572.0212. FILING BY UNSALARIED APPOINTED OFFICER NOT |
|
REQUIRED. (a) In this section, "salary" means a salary for state |
|
service, but not a per diem or other form of compensation. |
|
(b) An appointed officer, including an appointed officer of |
|
a major state agency, is not required to file a financial statement |
|
if the officer: |
|
(1) is not authorized to receive a salary; and |
|
(2) does not receive a salary. |
|
(c) To be eligible for the exemption under Subsection (b), |
|
the officer must provide written notice that the officer satisfies |
|
the requirements of that subsection to the commission. |
|
SECTION 2. Section 572.0212, Government Code, as added by |
|
this Act, applies to a financial statement filed under Subchapter |
|
B, Chapter 572, Government Code, regardless of whether the |
|
statement was required to be filed before, on, or after the |
|
effective date of this Act. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
