A BILL TO BE ENTITLED
AN ACT
relating to crediting electricity sold to manufacture recycled
products toward this state's goal for renewable energy.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 39.904, Utilities Code, is amended by
adding Subsection (f-1) to read as follows:
       (f-1)  A retail electric provider, municipally owned
utility, or electric cooperative may credit toward satisfaction of
the requirements of this section electricity sold under an
uninterruptible contract to a facility used to manufacture a
recycled product. In this subsection:
             (1)  "Recycled material" has the meaning assigned by
Section 361.421, Health and Safety Code.
             (2)  "Recycled product" means a product that consists
of at least 50 percent recycled material.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
