A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to crediting electricity sold to manufacture recycled |
|
|
products toward this state's goal for renewable energy. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 39.904, Utilities Code, is amended by |
|
|
adding Subsection (f-1) to read as follows: |
|
|
(f-1) A retail electric provider, municipally owned |
|
|
utility, or electric cooperative may credit toward satisfaction of |
|
|
the requirements of this section electricity sold under an |
|
|
uninterruptible contract to a facility used to manufacture a |
|
|
recycled product. In this subsection: |
|
|
(1) "Recycled material" has the meaning assigned by |
|
|
Section 361.421, Health and Safety Code. |
|
|
(2) "Recycled product" means a product that consists |
|
|
of at least 50 percent recycled material. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
