A BILL TO BE ENTITLED
AN ACT
relating to an immunization awareness program in certain school
districts.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter A, Chapter 38, Education Code, is
amended by adding Section 38.019 to read as follows:
       Sec. 38.019.  IMMUNIZATION AWARENESS PROGRAM. (a) A school
district that maintains an Internet website shall post prominently
on the website a list of:
             (1)  the immunizations required for admission to public
school by rules of the Department of State Health Services adopted
under Section 38.001;
             (2)  any immunizations, in addition to immunizations
listed under Subdivision (1), required for admission to public
school by the board of trustees of the district;
             (3)  any immunizations or vaccines recommended for
public school students by the Department of State Health Services
or the board of trustees of the district; and
             (4)  health clinics in the district that offer the
influenza vaccine.
       (b)  The list of recommended immunizations or vaccines under
Subsection (a)(3) must include the influenza vaccine, unless the
Department of State Health Services or board of trustees requires
the influenza vaccine for admission to public school.
       SECTION 2.  Section 38.019, Education Code, as added by this
Act, applies beginning with the 2007-2008 school year.
       SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
