A BILL TO BE ENTITLED
AN ACT
relating to the effect of changes in enrollment due to military
service on state appropriations for public junior colleges.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter A, Chapter 130, Education Code, is
amended by adding Section 130.0037 to read as follows:
       Sec. 130.0037.  EFFECT OF DECREASES IN ENROLLMENT DUE TO
MILITARY SERVICE ON STATE APPROPRIATION.  (a) Notwithstanding any
other law, if the student enrollment determined on the basis of
contact hours of a public junior college in an academic year has
decreased from the preceding academic year by two percent or more
and at least two percent of the decrease is a result of students of
the public junior college being called to active duty in the armed
forces of the United States, including the National Guard, the
share of state appropriations determined under Section 130.003 to
which the junior college is entitled based on the academic year in
which the enrollment decrease occurred shall be determined as if
the portion of the enrollment decrease resulting from students
being called to active duty did not occur.
       (b)  The governing board of a public junior college shall
certify a decrease in enrollment described by Subsection (a) to the
Texas Higher Education Coordinating Board in the manner prescribed
by the coordinating board.
       SECTION 2.  The change in law made by this Act applies to
appropriation recommendations for public junior colleges made by
the Texas Higher Education Coordinating Board on or after the
effective date of this Act. Appropriation recommendations for
public junior colleges made by the Texas Higher Education
Coordinating Board before the effective date of this Act are
covered by the law in effect immediately before the effective date
of this Act, and the former law is continued in effect for that
purpose.
       SECTION 3.  This Act takes effect September 1, 2007.
