A BILL TO BE ENTITLED
AN ACT
relating to certain incentives offered in relation to an accident
and health insurance policy for participation in health promotion
or disease prevention programs.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter A, Chapter 1201, Insurance Code, is
amended by adding Section 1201.013 to read as follows:
       Sec. 1201.013.  HEALTH PROMOTION AND DISEASE PREVENTION
PROGRAMS. (a) An insurer issuing an accident and health insurance
policy may establish a premium discount, rebate, or reduction in an
otherwise applicable copayment or deductible for an insured who
adheres to a program of health promotion or disease prevention.
       (b)  A discount, rebate, or reduction established under this
section does not violate Section 541.056(a).
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
