A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the prosecution and punishment of offenses regarding |
|
the management of certain funds delivered to a crime stoppers |
|
organization. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. The heading to Section 414.010, Government Code, |
|
is amended to read as follows: |
|
Sec. 414.010. PAYMENTS FROM DEFENDANTS ON COMMUNITY |
|
SUPERVISION; REWARD REPAYMENTS; OFFENSES. |
|
SECTION 2. Section 414.010, Government Code, is amended by |
|
adding Subsections (e), (f), (g), and (h) to read as follows: |
|
(e) A person who recklessly violates Subsection (a) by using |
|
more than 20 percent of the money annually received to pay costs |
|
incurred in administering the organization commits an offense that |
|
is a Class B misdemeanor. |
|
(f) A person who knowingly fails to establish an account |
|
under Subsection (b) commits an offense that is a Class A |
|
misdemeanor. |
|
(g) A person who knowingly fails to return unexpended money |
|
to the comptroller under Subsection (c) commits an offense that is a |
|
felony of the third degree unless the amount of the unexpended money |
|
is more than $100,000, in which event the offense is a felony of the |
|
second degree. |
|
(h) For the purposes of prosecution of an offense under |
|
Subsection (e), interest earned on funds and paid to administer an |
|
organization as permitted by Subsection (d) may not be used to |
|
calculate whether the actor committed the offense. |
|
SECTION 3. The change in law made by this Act applies only |
|
to an offense committed on or after the effective date of this Act. |
|
An offense committed before the effective date of this Act is |
|
governed by the law in effect when the offense was committed, and |
|
the former law is continued in effect for that purpose. For |
|
purposes of this section, an offense is committed before the |
|
effective date of this Act if any element of the offense occurs |
|
before the effective date. |
|
SECTION 4. This Act takes effect September 1, 2007. |
