A BILL TO BE ENTITLED
AN ACT
relating to the eligibility of certain transfer students for a
TEXAS grant.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  This Act shall be known as the "Ladders to
College Success Act."
       SECTION 2.  Subchapter M, Chapter 56, Education Code, is
amended by adding Section 56.3051 to read as follows:
       Sec. 56.3051.  ELIGIBILITY OF CERTAIN TRANSFER STUDENTS TO
RECEIVE TEXAS GRANTS. (a)  A person who otherwise meets the
requirements of Section 56.305 but who has not previously received
a TEXAS grant may receive a TEXAS grant under that section as if the
person had previously qualified for and received an initial TEXAS
grant if the person:
             (1)  qualified for a Texas Educational Opportunity
Grant under Subchapter P in the last semester or term the person
attended an eligible institution for purposes of Subchapter P,
without regard to whether the person received a grant under
Subchapter P; and
             (2)  meets either of the following academic
requirements:
                   (A)  received an associate degree from an
institution of higher education not earlier than May 1, 2001; or
                   (B)  completed the core curriculum at an
institution of higher education.
       (b)  The total number of semester credit hours, or the
equivalent, for which the person may receive a Texas Educational
Opportunity Grant or a TEXAS grant may not exceed the total number
of hours for which a student not covered by this section may receive
a TEXAS grant under Section 56.304(d).
       SECTION 3.  The change in law made by this Act relating to
the eligibility of a student for a TEXAS grant applies beginning
with grants awarded for the 2007-2008 academic year. Grants
awarded for an academic year before the 2007-2008 academic year are
governed by the law in effect immediately before the effective date
of this Act, and the former law is continued in effect for that
purpose.
       SECTION 4.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
