A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to possession of firearms and ammunition in certain foster |
|
|
homes. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 42.042, Human Resources Code, is amended |
|
|
by adding Subsection (e-1) to read as follows: |
|
|
(e-1) The department may not prohibit possession of lawfully |
|
|
permitted firearms and ammunition in a foster home of any type, |
|
|
including a foster group home, a foster home, an agency foster group |
|
|
home, and an agency foster home. Minimum standards may be adopted |
|
|
under this section relating to safety and proper storage of |
|
|
firearms and ammunition, including standards requiring firearms |
|
|
and ammunition to be stored separately in locked locations. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
