A BILL TO BE ENTITLED
|

AN ACT
|
|
relating to the appeal by an individual entitled to a veteran's |
|
preference of certain adverse employment decisions. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 657, Government Code, is amended by |
|
adding Section 657.010 to read as follows: |
|
Sec. 657.010. SUIT TO APPEAL EMPLOYMENT DECISION OF PUBLIC |
|
ENTITY OR PUBLIC WORK. (a) An individual entitled to a veteran's |
|
employment preference under this chapter who is aggrieved by a |
|
decision of a public entity or public work of this state to which |
|
this chapter applies relating to hiring the individual, or relating |
|
to retaining the individual if the entity or work reduces its |
|
workforce, may appeal the decision by bringing a cause of action |
|
against the public entity or public work under this section. |
|
(b) An individual who prevails in a suit brought by the |
|
individual under this section is entitled to: |
|
(1) reasonable damages incurred by the individual as a |
|
result of the adverse employment decision; and |
|
(2) reasonable attorney's fees and costs incurred by |
|
the individual in the suit. |
|
SECTION 2. Section 657.010, Government Code, as added by |
|
this Act, applies only to an employment decision made by a public |
|
entity or a public work to which Chapter 657, Government Code, |
|
applies, on or after the effective date of this Act. An employment |
|
decision made before the effective date of this Act is governed by |
|
the law in effect immediately before that date, and the former law |
|
is continued in effect for that purpose. |
|
SECTION 3. This Act takes effect September 1, 2007. |
