A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the qualifications of a person in the chain of command |
|
|
over fire protection personnel. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 419.032, Government Code, is amended by |
|
|
adding Subsection (f-1) to read as follows: |
|
|
(f-1) Except as provided by Subsection (f), a person may not |
|
|
supervise fire protection personnel and make operational decisions |
|
|
about the performance of a duty listed under Section 419.021(3)(C) |
|
|
unless the supervisor is certified by the commission in at least one |
|
|
of the specific disciplines in which duties are being performed by |
|
|
the person's subordinate(s) in an area listed under Section |
|
|
419.021(3)(C). This subsection does not prohibit a person who is |
|
|
not certified as fire protection personnel from making decisions |
|
|
about the budget of the fire department, nor does it require that |
|
|
the supervisor of the Fire Chief be certified by the Commission. |
|
|
This section does not apply to a part time or full time fire fighter |
|
|
while the fire fighter is on active duty in a fire department that |
|
|
is considered a combination fire department that is a voluntary |
|
|
participant in the commission. |
|
|
SECTION 2. This Act takes effect September 1, 2007. |
