A BILL TO BE ENTITLED
AN ACT
relating to prohibiting an agency or political subdivision of this
state, in connection with a public road, highway, toll road, port,
or related infrastructure under its jurisdiction, from granting an
interest in the property to a private entity.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Chapter 472, Transportation Code, is amended by
adding Subchapter E to read as follows:
SUBCHAPTER E. PROHIBITION AGAINST GRANTING OF PROPERTY
INTEREST IN CERTAIN PUBLIC ROADS, HIGHWAYS,
TOLL ROADS, OR RELATED INFRASTRUCTURE TO
PRIVATE ENTITY
       Sec. 472.101.  PROHIBITION AGAINST GRANTING OF PROPERTY
INTEREST. Notwithstanding any other law to the contrary, an agency
or political subdivision of this state, in connection with a public
road, highway, toll road, port, or related infrastructure under its
jurisdiction, may not:
             (1)  grant an ownership or leasehold interest in the
property to a private entity; or
             (2)  permit all or any part of the property to come
under the control of a private entity.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
