A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to housing conditions for inmates confined in a facility |
|
|
operated by or under contract with the Texas Department of Criminal |
|
|
Justice. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 495, Government Code, is |
|
|
amended by adding Section 495.009 to read as follows: |
|
|
Sec. 495.009. PROHIBITED CONTRACT PROVISION REGARDING |
|
|
SQUARE FOOTAGE PER INMATE. The board may not require in a contract |
|
|
with a private vendor under this subchapter that the secure |
|
|
correctional facility operated by the private vendor contain more |
|
|
square footage per inmate than the least amount of square footage |
|
|
per inmate contained in any existing facility operated by the |
|
|
department. |
|
|
SECTION 2. Section 501.111(a), Government Code, is |
|
|
repealed. |
|
|
SECTION 3. Section 495.009, Government Code, as added by |
|
|
this Act, applies only to a contract between the Texas Department of |
|
|
Criminal Justice and a private vendor entered into on or after the |
|
|
effective date of this Act. A contract entered into before the |
|
|
effective date of this Act is covered by the law in effect on the |
|
|
date the contract was entered into, and the former law is continued |
|
|
in effect for that purpose. |
|
|
SECTION 4. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
