A BILL TO BE ENTITLED
AN ACT
relating to restrictions on the substitution of generically
equivalent versions of transplant immunosuppresants.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter A, Chapter 562, Occupations Code, is
amended by adding Section 562.0142 to read as follows:
       Sec. 562.0142.  SELECTION OF TRANSPLANT IMMUNOSUPPRESANTS.  
(a)  Except as provided by Subsection (b), a pharmacist may not
dispense a drug for immunosuppressive therapy following transplant
unless the drug is the specific formulation and manufactured by the
specific manufacturer that is prescribed by the patient's
physician.
       (b)  A pharmacist may substitute a drug product that is
generically equivalent for immunosuppressive therapy following
transplant only if, before making the substitution, the pharmacist
obtains a signed authorization from the prescribing physician.
       SECTION 2.  This Act takes effect September 1, 2007.
