A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to state funding for certain students subject to school |
|
|
district disciplinary action. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 37.005, Education Code, is amended by |
|
|
adding Subsection (c) to read as follows: |
|
|
(c) Notwithstanding any other provision of this code, a |
|
|
student who is suspended under this section is counted in computing |
|
|
the average daily attendance of students in the district. |
|
|
SECTION 2. Section 37.008(f), Education Code, is amended to |
|
|
read as follows: |
|
|
(f) A student removed to a disciplinary alternative |
|
|
education program is counted in computing the average daily |
|
|
attendance of students in the district [for the student's time in
|
|
|
actual attendance in the program]. |
|
|
SECTION 3. This Act applies beginning with the 2007-2008 |
|
|
school year. |
|
|
SECTION 4. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
