A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to permits issued by political subdivisions. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subtitle C, Title 7, Local Government Code, is |
|
|
amended by amending Section 245.004(9) to read as follows: |
|
|
(9) notwithstanding any other limitation in this |
|
|
section, regulations to prevent imminent destruction of property or |
|
|
injury to persons from flooding that are effective only within a
|
|
|
flood plain established by a federal flood control program and
|
|
|
enacted to prevent the flooding of buildings intended for public
|
|
|
occupancy; |
|
|
SECTION 2. Subtitle C, Title 7, Local Government Code, is |
|
|
amended by repealing Section 245.004(11) in its entirety. |
|
|
SECTION 3. Section 245.004, Local Government Code, as |
|
|
amended by this Act, applies to a person who files a permit |
|
|
application before, on, or after the effective date of this Act. |
|
|
SECTION 4. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
