A BILL TO BE ENTITLED
AN ACT
relating to the creation of a submersion injury and drowning
prevention database.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter A, Chapter 92, Health and Safety
Code, is amended by adding Section 92.012 to read as follows:
       Sec. 92.012. SUBMERSION INJURY AND DROWNING PREVENTION
DATABASE. (a) The department shall collect and analyze information
related to submersion injuries and drowning at the state and
regional level, and to the extent feasible, at the local level. The
department shall obtain the information in the manner required by
other state law and may obtain additional information from federal
agencies or private and public organizations. The department shall
maintain a database of this information.
       (b)  The database may include:
             (1)  information related to risk factors identified for
submersion injuries and drowning;
             (2)  morbidity and mortality rates for submersion
injuries and drowning; and
             (3)  community indicators relevant to submersion
injuries and drowning.
       (c)  In compiling the database, the department may use
information available from other sources, such as reports of
hospital discharge data, information included in death
certificates, or information previously collected by the
department.
       (d)  The department may identify additional information to
be included in the database. To the extent that information is
available, the department may collect the information and include
the information in the database.
       (e)  The department shall make the information in the
database available to the public in a manner designed to inform the
public on a local, regional, and statewide basis of:
             (1)  the risk factors associated with submersion
injuries and drowning; and
             (2)  preventative measures that may reduce the risk of
submersion injury and drowning.
       (f)  Information obtained by the department under this
section that identifies an individual or that is otherwise
confidential under law is confidential, is excepted from required
public disclosure under Chapter 552, Government Code, and may not
be disclosed for any purpose.
       SECTION 2.  This Act takes effect September 1, 2007.
