A BILL TO BE ENTITLED
AN ACT
relating to the dissemination of false or misleading information by
a professional association or organization for educators;
providing a civil penalty.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter I, Chapter 21, Education Code, is
amended by adding Section 21.4081 to read as follows:
       Sec. 21.4081.  DISSEMINATION OF FALSE OR MISLEADING
INFORMATION BY PROFESSIONAL ASSOCIATION. (a) A professional
association or organization for educators may not disseminate any
form of false or misleading information, including information that
omits relevant facts in order to elicit a particular opinion.
       (b)  The office of the attorney general may take any action
necessary to enforce this section, including by imposing a civil
penalty on a professional association or organization for educators
that violates this section.
       (c)  The attorney general shall adopt rules necessary to
administer this section.
       SECTION 2.  Section 21.4081, Education Code, as added by
this Act, applies only to information disseminated by a
professional association or organization for educators on or after
the effective date of this Act. Information disseminated by a
professional association or organization for educators before the
effective date of this Act is governed by the law in effect when the
information was disseminated, and the former law is continued in
effect for that purpose.
       SECTION 3.  This Act takes effect September 1, 2007.
