A BILL TO BE ENTITLED
AN ACT
relating to the certification of eligibility for Medicaid for
certain persons in the armed forces and their family members.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 32.026, Human Resources Code, is amended
by adding Subsection (d-1) to read as follows:
       (d-1)  In adopting rules under this section, the executive
commissioner of the Health and Human Services Commission shall
ensure, to the extent allowed by federal law, that documentation
and verification procedures used in determining and certifying the
eligibility and need for medical assistance of a person who is on
active duty as a member of the armed forces of the United States or
the state military forces, or of the spouse or dependent of that
person, are expedited in the same manner as the documentation and
verification procedures used to determine and certify the
eligibility of a person for emergency medical assistance are
expedited.
       SECTION 2.  If before implementing any provision of this Act
a state agency determines that a waiver or authorization from a
federal agency is necessary for implementation of that provision,
the agency affected by the provision shall request the waiver or
authorization and may delay implementing that provision until the
waiver or authorization is granted.
       SECTION 3.  This Act takes effect September 1, 2007.
