A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the certification of eligibility for Medicaid for |
|
certain persons in the armed forces and their family members. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 32.026, Human Resources Code, is amended |
|
by adding Subsection (d-1) to read as follows: |
|
(d-1) In adopting rules under this section, the executive |
|
commissioner of the Health and Human Services Commission shall |
|
ensure, to the extent allowed by federal law, that documentation |
|
and verification procedures used in determining and certifying the |
|
eligibility and need for medical assistance of a person who is on |
|
active duty as a member of the armed forces of the United States or |
|
the state military forces, or of the spouse or dependent of that |
|
person, are expedited in the same manner as the documentation and |
|
verification procedures used to determine and certify the |
|
eligibility of a person for emergency medical assistance are |
|
expedited. |

SECTION 2. If before implementing any provision of this Act |
|
a state agency determines that a waiver or authorization from a |
|
federal agency is necessary for implementation of that provision, |
|
the agency affected by the provision shall request the waiver or |
|
authorization and may delay implementing that provision until the |
|
waiver or authorization is granted. |
|
SECTION 3. This Act takes effect September 1, 2007. |
