A BILL TO BE ENTITLED
AN ACT
relating to a requirement that an applicant for an original
driver's license complete a course on the laws relating to driving
while intoxicated.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter G, Chapter 521, Transportation Code,
is amended by adding Section 521.148 to read as follows:
       Sec. 521.148.  COURSE ON LAWS APPLICABLE TO DRIVING WHILE
INTOXICATED REQUIRED. (a)  The department may not issue an original
driver's license to an applicant unless the applicant has completed
and passed a course on the laws relating to driving while
intoxicated, including the consequences of committing the offense
of driving while intoxicated.
       (b)  The department by rule shall prescribe:
             (1)  the curriculum for the course;
             (2)  the qualifications required for course providers;
             (3)  the form of proof required to establish successful
completion of the course; and
             (4)  other requirements the department considers
necessary.
       (c)  Rules adopted under Subsection (b) may provide that an
applicant may satisfy the requirements of this section by
submitting a certificate issued under Chapter 1001, Education Code,
that states that the applicant has completed and passed a driver
education course.
       (d)  This section does not apply to renewal of a driver's
license.
       SECTION 2.  The change in law made by this Act applies only
to an application for the issuance of an original driver's license
submitted on or after the effective date of this Act. An
application for the issuance of an original driver's license
submitted before the effective date of this Act is governed by the
law in effect when the application is submitted, and the former law
is continued in effect for that purpose.
       SECTION 3.  This Act takes effect September 1, 2007.
