A BILL TO BE ENTITLED
AN ACT
relating to the authority of the Texas State Board of Podiatric
Medical Examiners to conduct certain criminal investigations.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter M, Chapter 202, Occupations Code, is
amended by adding Section 202.6035 to read as follows:
       Sec. 202.6035.  CRIMINAL INVESTIGATIONS. (a)  A board
investigator may investigate suspected criminal acts relating to
the practice of podiatry as authorized by this chapter and shall
assist federal, state, or local law enforcement agencies in the
investigation and prosecution of offenses related to the practice
of podiatry.
       (b)  In conducting a criminal investigation, the board may
receive relevant information from a law enforcement agency.
Information received by the board from a law enforcement agency is
confidential and may not be disclosed except as necessary to
conduct the investigation.
       (c)  A board investigator conducting a criminal
investigation is not a peace officer.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
