A BILL TO BE ENTITLED
|

AN ACT
|
|
relating to the authority of the Texas State Board of Podiatric |
|
Medical Examiners to conduct certain criminal investigations. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter M, Chapter 202, Occupations Code, is |
|
amended by adding Section 202.6035 to read as follows: |
|
Sec. 202.6035. CRIMINAL INVESTIGATIONS. (a) A board |
|
investigator may investigate suspected criminal acts relating to |
|
the practice of podiatry as authorized by this chapter and shall |
|
assist federal, state, or local law enforcement agencies in the |
|
investigation and prosecution of offenses related to the practice |
|
of podiatry. |
|
(b) In conducting a criminal investigation, the board may |
|
receive relevant information from a law enforcement agency. |
|
Information received by the board from a law enforcement agency is |
|
confidential and may not be disclosed except as necessary to |
|
conduct the investigation. |
|
(c) A board investigator conducting a criminal |
|
investigation is not a peace officer. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
