A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the entitlement of certain students to attend a public |
|
school campus at which a full-time registered nurse is assigned. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter B, Chapter 25, Education Code, is |
|
amended by adding Section 25.045 to read as follows: |
|
Sec. 25.045. TRANSFER OF CERTAIN STUDENTS TO CAMPUS WITH |
|
FULL-TIME REGISTERED SCHOOL NURSE. (a) This section applies only |
|
to: |
|
(1) a student who: |
|
(A) has a severe food allergy, as defined by |
|
commissioner rule; and |
|
(B) is assigned to a campus that does not have a |
|
full-time registered school nurse assigned to the campus; or |
|
(2) the sibling of a student described by Subdivision |
|
(1). |
|
(b) A student described by Subsection (a)(1) is entitled to |
|
transfer to another campus in the student's school district of |
|
residence or to a campus in another school district in order to |
|
attend a campus at which a full-time registered school nurse is |
|
assigned. |
|
(c) The sibling of a student described by Subsection (a)(1) |
|
is entitled to transfer to another campus under this section only in |
|
order to attend the same campus as the student. |
|
(d) A school district is not required to provide |
|
transportation to a student who transfers to another campus under |
|
this section. |
|
(e) The commissioner shall adopt rules necessary to |
|
administer this section, including rules providing for the transfer |
|
of state funds in the manner provided by Section 25.037. |
|
SECTION 2. This Act applies beginning with the 2007-2008 |
|
school year. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
