A BILL TO BE ENTITLED
AN ACT
relating to the entitlement of certain students to attend a public
school campus at which a full-time registered nurse is assigned.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter B, Chapter 25, Education Code, is
amended by adding Section 25.045 to read as follows:
       Sec. 25.045.  TRANSFER OF CERTAIN STUDENTS TO CAMPUS WITH
FULL-TIME REGISTERED SCHOOL NURSE. (a) This section applies only
to:
             (1)  a student who:
                   (A)  has a severe food allergy, as defined by
commissioner rule; and
                   (B)  is assigned to a campus that does not have a
full-time registered school nurse assigned to the campus; or
             (2)  the sibling of a student described by Subdivision
(1).
       (b)  A student described by Subsection (a)(1) is entitled to
transfer to another campus in the student's school district of
residence or to a campus in another school district in order to
attend a campus at which a full-time registered school nurse is
assigned.
       (c)  The sibling of a student described by Subsection (a)(1)
is entitled to transfer to another campus under this section only in
order to attend the same campus as the student.
       (d)  A school district is not required to provide
transportation to a student who transfers to another campus under
this section.
       (e)  The commissioner shall adopt rules necessary to
administer this section, including rules providing for the transfer
of state funds in the manner provided by Section 25.037.
       SECTION 2.  This Act applies beginning with the 2007-2008
school year.
       SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
