A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to certain persons that are special investigators. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Article 2.122(b), Code of Criminal Procedure, is |
|
|
amended to read as follows: |
|
|
(b) A person designated as an officer or agent for duty in |
|
|
connection with the protection of property and persons on the |
|
|
property [a special policeman] by the Secretary of Homeland |
|
|
Security under 40 U.S.C. Section 1315 [Federal Protective Services
|
|
|
division of the General Services Administration under 40 U.S.C.
|
|
|
Section 318 or 318d] is not a peace officer but has the powers of |
|
|
arrest and search and seizure as to any offense under the laws of |
|
|
this state. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
