A BILL TO BE ENTITLED
 
AN ACT
 
  relating to exempting certain state agencies from certain laws
  relating to real property transactions.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 31, Natural Resources
  Code, is amended by adding Section 31.002 to read as follows:
         Sec. 31.002.  EXEMPTION FROM CERTAIN REAL ESTATE TRANSACTION
  LAWS. (a)  Unless the statute specifically states that the statute
  applies to the land office, the following statutes do not apply to
  the land office:
               (1)  a statute that would require the land office to
  provide a notice or disclosure to a buyer of real property; and
               (2)  a statute relating to the sale, purchase, or
  financing of real property by an executory contract, including a
  contract for deed or other similar sale.
         (b)  This section does not affect the application of a
  statute described by Subsection (a)(2) to a party involved in a
  transaction with the land office.
         SECTION 2.  Subchapter D, Chapter 32, Natural Resources
  Code, is amended by adding Section 32.113 to read as follows:
         Sec. 32.113.  EXEMPTION FROM CERTAIN REAL ESTATE TRANSACTION
  LAWS. (a)  Unless the statute specifically states that the statute
  applies to the board, the following statutes do not apply to the
  board:
               (1)  a statute that would require the board to provide a
  notice or disclosure to a buyer of real property; and
               (2)  a statute relating to the sale, purchase, or
  financing of real property by an executory contract, including a
  contract for deed or other similar sale.
         (b)  This section does not affect the application of a
  statute described by Subsection (a)(2) to a party involved in a
  transaction with the board.
         SECTION 3.  Subchapter F, Chapter 161, Natural Resources
  Code, is amended by adding Section 161.237 to read as follows:
         Sec. 161.237.  EXEMPTION FROM CERTAIN REAL ESTATE
  TRANSACTION LAWS. (a)  Unless the statute specifically states that
  the statute applies to the board, the following statutes do not
  apply to the board:
               (1)  a statute that would require the board to provide a
  notice or disclosure to a buyer of real property; and
               (2)  a statute relating to the sale, purchase, or
  financing of real property by an executory contract, including a
  contract for deed or other similar sale.
         (b)  This section does not affect the application of a
  statute described by Subsection (a)(2) to a party involved in a
  transaction with the board.
         SECTION 4.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2007.
