A BILL TO BE ENTITLED
AN ACT
relating to penalties for certain violations by a person or
facility certified to conduct vehicle and equipment inspections
required by law.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 548.405(h), Transportation Code, is
amended to read as follows:
       (h)  The department shall develop and implement [, by
September 1, 2002,] a penalty schedule consisting of warnings,
re-education, suspensions, and revocations based on the severity
and frequency of violations of:
             (1)  this chapter, including Subchapter F;
             (2)  Section 382.202, Health and Safety Code; [offenses
committed under Chapter 548, Transportation Code,] and
             (3)  rules adopted [by the department] under those
provisions [this chapter].
       SECTION 2.  Sections 548.405(c) and (i), Transportation
Code, are repealed.
       SECTION 3.  The change in law made by this Act to Section
548.405, Transportation Code, applies to a violation described by
Section 548.405(h), Transportation Code, as amended by this Act,
committed on or after the effective date of this Act. A violation
committed before the effective date of this Act is covered by the
law in effect when the violation was committed, and the former law
is continued in effect for that purpose. For purposes of this
section, a violation was committed before the effective date of
this Act if any element of the violation occurred before that date.
       SECTION 4.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
