A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to penalties for certain violations by a person or |
|
facility certified to conduct vehicle and equipment inspections |
|
required by law. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 548.405(h), Transportation Code, is |
|
amended to read as follows: |
|
(h) The department shall develop and implement [, by
|
|
September 1, 2002,] a penalty schedule consisting of warnings, |
|
re-education, suspensions, and revocations based on the severity |
|
and frequency of violations of: |
|
(1) this chapter, including Subchapter F; |
|
(2) Section 382.202, Health and Safety Code; [offenses
|
|
committed under Chapter 548, Transportation Code,] and |
|
(3) rules adopted [by the department] under those |
|
provisions [this chapter]. |
|
SECTION 2. Sections 548.405(c) and (i), Transportation |
|
Code, are repealed. |
|
SECTION 3. The change in law made by this Act to Section |
|
548.405, Transportation Code, applies to a violation described by |
|
Section 548.405(h), Transportation Code, as amended by this Act, |
|
committed on or after the effective date of this Act. A violation |
|
committed before the effective date of this Act is covered by the |
|
law in effect when the violation was committed, and the former law |
|
is continued in effect for that purpose. For purposes of this |
|
section, a violation was committed before the effective date of |
|
this Act if any element of the violation occurred before that date. |
|
SECTION 4. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
