A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the confidentiality of certain information involving |
|
|
the Public Utility Commission and the wholesale electric market |
|
|
monitor. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 39.1515, Utilities Code, is amended by |
|
|
adding Subsection (b-1) to read as follows: |
|
|
(b-1) Information provided to the market monitor under |
|
|
Subsection (b) or obtained by the market monitor in monitoring and |
|
|
overseeing the wholesale electric market is confidential and is not |
|
|
subject to disclosure under Chapter 552, Government Code. |
|
|
SECTION 2. Subchapter D, Chapter 551, Government Code, is |
|
|
amended by adding Section 551.0861 to read as follows: |
|
|
Sec. 551.0861. PUBLIC UTILITY COMMISSION. This chapter |
|
|
does not require the Public Utility Commission to conduct an open |
|
|
meeting to deliberate a matter made confidential by law or to |
|
|
discuss or consider information that is confidential by law. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
