A BILL TO BE ENTITLED
AN ACT
relating to coordination between school districts and other
governmental agencies regarding necessary transportation
infrastructure improvements associated with real property owned or
proposed to be purchased by school districts.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter Z, Chapter 44, Education Code, is
amended by adding Section 44.903 to read as follows:
       Sec. 44.903.  COORDINATION WITH OTHER GOVERNMENTAL AGENCIES
REGARDING NECESSARY TRANSPORTATION INFRASTRUCTURE
IMPROVEMENTS.  (a)  Before a school district may issue bonds or
enter into a contract to construct a facility to be used for any
purpose on real property owned by the district on September 1, 2007,
the board of trustees of the district must hold a joint meeting with
representatives of the Texas Department of Transportation district
office for the departmental district in which the school district's
central administrative office is located and:
             (1)  the governing body of each municipality in which
or in whose extraterritorial jurisdiction any part of the property
is located; and
             (2)  the commissioners court of each county in which
any part of the property is located.
       (b)  A meeting held under Subsection (a) must address, with
respect to each school district facility planned or expected to be
constructed on the real property owned or proposed to be purchased
by the district:
             (1)  the impact of the facility on traffic and the
transportation infrastructure in the area of the facility;
             (2)  the cost of any necessary associated
transportation infrastructure improvements; and
             (3)  each entity that will be responsible for paying
for any necessary associated transportation infrastructure
improvements.
       (c)  A meeting held under Subsection (a) must be an open
meeting as provided by Chapter 551, Government Code, except that
the meeting may be a closed meeting if:
             (1)  the meeting involves real property the school
district proposes to purchase; and
             (2)  the board of trustees would be authorized to
conduct a closed meeting under Section 551.072, Government Code, in
relation to the purchase of the property.
       SECTION 2.  This Act takes effect September 1, 2007.
