A BILL TO BE ENTITLED
AN ACT
relating to the establishment by the Commission on Law Enforcement
Officer Standards and Education of a training program for law
enforcement officers regarding the use of a Taser or other stun gun.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter H, Chapter 1701, Occupations Code, is
amended by adding Section 1701.3521 to read as follows:
       Sec. 1701.3521.  TRAINING PROGRAM REGARDING USE OF TASER OR
OTHER STUN GUN. (a) In this section:
             (1)  "Stun gun" means a device that is intended,
designed, made, or adapted to immobilize a person by inflicting an
electrical charge.
             (2)  "Taser" means a stun gun manufactured, sold, or
distributed by Taser International, Incorporated.
       (b)  The commission shall require a state, county, special
district, or municipal agency that appoints or employs peace
officers to provide each peace officer with a training program
established by the commission regarding the use by a peace officer
of a Taser or other stun gun.
       (c)  The commission by rule shall establish the:
             (1)  training program requirements, including the
frequency with which a peace officer must complete the training
program; and
             (2)  date by which the peace officer must complete the
officer's initial training program.
       SECTION 2.  Not later than March 1, 2008, the Commission on
Law Enforcement Officer Standards and Education shall establish the
training program required by Section 1701.3521, Occupations Code,
as added by this Act.
       SECTION 3.  This Act takes effect September 1, 2007.
