A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to disposition of state traffic fines. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 542.4031, Transportation Code, is |
|
amended by amending Subsection (e) and adding Subsection (f-1) to |
|
read as follows: |
|
(e) The custodian of money in a municipal or county treasury |
|
may deposit money collected under this section in an |
|
interest-bearing account. The custodian shall: |
|
(1) keep records of the amount of money collected |
|
under this section that is on deposit in the treasury; and |
|
(2) except as provided by Subsections (f) and (f-1), |
|
not later than the last day of the month following each calendar |
|
quarter, remit to the comptroller money collected under this |
|
section during the preceding quarter, as required by the |
|
comptroller. |
|
(f-1) A municipality or county may retain the entire amount |
|
of the money collected under this section in connection with a |
|
violation of Chapter 681. Money retained under this subsection |
|
shall be used only to: |
|
(1) construct curb cuts and other accessibility |
|
improvements in the municipality or county; or |
|
(2) fund paratransit or demand response |
|
transportation systems for individuals with disabilities. |
|
SECTION 2. The change in law made by this Act applies only |
|
to money collected on or after the effective date of this Act. |
|
Money collected before the effective date of this Act is governed by |
|
the law in effect when the fine was collected, and the former law is |
|
continued in effect for that purpose. |
|
SECTION 3. This Act takes effect October 1, 2007. |
