A BILL TO BE ENTITLED
AN ACT
relating to the penalty for being in violation of financial
responsibility requirements at the time of causing a motor vehicle
accident.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 601.191, Transportation Code, is amended
by amending Subsection (b) and adding Subsection (c-1) to read as
follows:
       (b)  Except as provided by Subsections (c), (c-1), and (d),
an offense under this section is a misdemeanor punishable by a fine
of not less than $175 or more than $350.
       (c-1)  If it is shown on the trial of an offense under this
section that the defendant was operating a motor vehicle in
violation of Section 601.051 at the time the defendant caused a
motor vehicle accident, the offense is a Class B misdemeanor.
       SECTION 2.  (a)  The change in law made by this Act applies
only to an offense committed on or after the effective date of this
Act. For the purposes of this section, an offense is committed
before the effective date of this Act if any element of the offense
occurs before that date.
       (b)  An offense committed before the effective date of this
Act is governed by the law in effect when the offense was committed,
and the former law is continued in effect for that purpose.
       SECTION 3.  This Act takes effect September 1, 2007.
