A BILL TO BE ENTITLED
AN ACT
relating to the design and installation of signs at certain
crosswalks used regularly by elderly pedestrians.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Chapter 544, Transportation Code, is amended by
adding Section 544.0015 to read as follows:
       Sec. 544.0015.  SIGNAGE FOR CERTAIN CROSSWALKS. (a) The
manual adopted under Section 544.001 must include provisions for
the design and installation of warning signs to designate a marked
crosswalk that is used regularly by elderly pedestrians who:
             (1)  are unable to adequately judge when it is safe to
cross the roadway; or
             (2)  require a longer time to cross the roadway.
       (b)  The manual may not prohibit a local authority, in
connection with a roadway under its jurisdiction, from installing a
sign designed under Subsection (a) if the governing body of the
local authority determines that installation of the sign is:
             (1)  supported by an engineering and traffic
investigation; or
             (2)  in the best interest of or necessary for the
protection of elderly pedestrians who regularly use the marked
crosswalk.
       (c)  In connection with a roadway under the jurisdiction of a
local authority, on receipt of a petition signed by at least 10
adult individuals who reside within 2,500 feet of a crosswalk
described by Subsection (a) requesting the installation of a
warning sign authorized by that subsection, the governing body of
the local authority shall direct that:
             (1)  an engineering and traffic investigation be
performed to evaluate the request; or
             (2)  the sign be placed at the crosswalk, if the
governing body determines that installation of the sign is in the
best interest of or necessary for the protection of elderly
pedestrians who regularly use the crosswalk.
       SECTION 2.  This Act takes effect September 2, 2007.
