A BILL TO BE ENTITLED

AN ACT
|
|
|
relating to emission reduction strategies for greenhouse gases. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter B, Chapter 382, Health and Safety |
|
|
Code, is amended by adding Section 382.0174 to read as follows: |
|
|
Sec. 382.0174. EMISSION REDUCTION STRATEGIES FOR |
|
|
GREENHOUSE GASES. (a) In this section, "greenhouse gas" includes |
|
|
carbon dioxide, methane, nitrous oxide, hydrofluorocarbons, |
|
|
perfluorocarbons, and sulfur hexafluoride. |
|
|
(b) Not later than December 31, 2008, the commission shall |
|
|
prepare and deliver to each member of the legislature a report |
|
|
including a list of strategies for reducing emissions of greenhouse |
|
|
gases in this state. |
|
|
(c) In preparing the list of emission reduction strategies, |
|
|
the commission: |
|
|
(1) may not include a strategy that may result in a |
|
|
financial cost to the state or consumers or businesses in this |
|
|
state; and |
|
|
(2) shall consider: |
|
|
(A) any short-term or long-term net savings, |
|
|
including life-cycle savings, to the state or to consumers or |
|
|
businesses in this state that may result from the implementation of |
|
|
a strategy; and |
|
|
(B) strategies for reducing the emissions of |
|
|
greenhouse gases that have been implemented in other states or |
|
|
nations. |
|
|
(d) In determining under Subsection (c) whether an emission |
|
|
reduction strategy may result in a financial cost to the state or to |
|
|
consumers or businesses in this state, the commission shall |
|
|
consider: |
|
|
(1) the total net costs that may occur over the life of |
|
|
the strategy, as opposed to the short-term capital costs that may |
|
|
result from the implementation of the strategy; and |
|
|
(2) the total net costs that may occur across the |
|
|
state, as opposed to the costs to a particular sector of the state |
|
|
or a particular group of consumers or businesses in this state. |
|
|
(e) The commission may appoint advisory committees to |
|
|
assist the commission in identifying and evaluating greenhouse gas |
|
|
emission reduction strategies. |
|
|
(f) Not later than June 1, 2009, the commission shall adopt |
|
|
rules implementing each of the strategies in the report to the |
|
|
extent that the implementation does not conflict with other state |
|
|
law. The rules must require each strategy to become operational at |
|
|
the earliest practicable date and not later than June 1, 2010. |
|
|
SECTION 2. This Act takes effect September 1, 2007. |
