A BILL TO BE ENTITLED
AN ACT
relating to emission reduction strategies for greenhouse gases.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter B, Chapter 382, Health and Safety
Code, is amended by adding Section 382.0174 to read as follows:
       Sec. 382.0174.  EMISSION REDUCTION STRATEGIES FOR
GREENHOUSE GASES. (a) In this section, "greenhouse gas" includes
carbon dioxide, methane, nitrous oxide, hydrofluorocarbons,
perfluorocarbons, and sulfur hexafluoride.
       (b)  Not later than December 31, 2008, the commission shall
prepare and deliver to each member of the legislature a report
including a list of strategies for reducing emissions of greenhouse
gases in this state.
       (c)  In preparing the list of emission reduction strategies,
the commission:
             (1)  may not include a strategy that may result in a
financial cost to the state or consumers or businesses in this
state; and
             (2)  shall consider:
                   (A)  any short-term or long-term net savings,
including life-cycle savings, to the state or to consumers or
businesses in this state that may result from the implementation of
a strategy; and
                   (B)  strategies for reducing the emissions of
greenhouse gases that have been implemented in other states or
nations.
       (d)  In determining under Subsection (c) whether an emission
reduction strategy may result in a financial cost to the state or to
consumers or businesses in this state, the commission shall
consider:
             (1)  the total net costs that may occur over the life of
the strategy, as opposed to the short-term capital costs that may
result from the implementation of the strategy; and
             (2)  the total net costs that may occur across the
state, as opposed to the costs to a particular sector of the state
or a particular group of consumers or businesses in this state.
       (e)  The commission may appoint advisory committees to
assist the commission in identifying and evaluating greenhouse gas
emission reduction strategies.
       (f)  Not later than June 1, 2009, the commission shall adopt
rules implementing each of the strategies in the report to the
extent that the implementation does not conflict with other state
law. The rules must require each strategy to become operational at
the earliest practicable date and not later than June 1, 2010.
       SECTION 2.  This Act takes effect September 1, 2007.
