A BILL TO BE ENTITLED
 
AN ACT
 
  relating to police officers eligible to be certified to enforce
  commercial motor vehicle safety standards.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 644.101(b), Transportation Code, is
  amended to read as follows:
         (b)  A police officer of any of the following municipalities
  is eligible to apply for certification under this section:
               (1)  a municipality with a population of 100,000 or
  more;
               (2)  a municipality with a population of 60,000 or more
  any part of which is located in:
                     (A)  a county with a population of 750,000 or
  more; and
                     (B)  two or more counties with a combined
  population of one million or more;
               (3)  a municipality with a population of 25,000 or more
  any part of which is located in a county with a population of two
  million or more;
               (4) [(3)]  a municipality with a population of less
  than 25,000:
                     (A)  any part of which is located in a county with
  a population of 2.4 million; and
                     (B)  that contains or is adjacent to an
  international port; or
               (5) [(4)]  a municipality any part of which is located
  in a county bordering the United Mexican States.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2007.
