A BILL TO BE ENTITLED
AN ACT
relating to the information collected through the Public Education
Information Management System.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 42.006(d), Education Code, is amended to
read as follows:
       (d)  The commissioner's rules must ensure that the Public
Education Information Management System:
             (1)  links student performance data to other related
information for purposes of efficient and effective allocation of
scarce school resources, to the extent practicable using existing
agency resources and appropriations;
             (2)  contains a transcript for each student that
records:
                   (A)  the courses taken by the student and the
student's grades;
                   (B)  the identification number of the student's
teacher in each class or in each course in a major subject area, as
applicable;
                   (C)  the student's scores on national assessment
instruments administered by the state or school district;
                   (D)  any disciplinary warnings given and
disciplinary actions taken; and
                   (E)  any participation by the student in a magnet
school program that has criteria for admission other than the order
in which students' applications for admission are received or an
admissions lottery; and
             (3)  contains a record of each teacher's training,
experience, and continuing education and professional development
activities, including:
                   (A)  the type of each certification held by the
teacher;
                   (B)  the name of the educator preparation program
the teacher attended, the teacher's major field of postsecondary
study, the courses completed by the teacher, and the number of
semester credit hours and the overall grade the teacher earned in
each of those courses;
                   (C)  the number of years of teaching experience in
specified grade levels or courses, as applicable, and any
experience in an occupation other than teaching and the number of
years of such experience; and
                   (D)  the teacher's continuing education and
professional development activities, including the number of
instructional hours, type of instruction, instructor's name, name
of the entity providing the instruction, and date completed.
       SECTION 2.  Not later than December 31, 2007, the
commissioner of education shall adopt rules requiring school
districts and educator preparation programs in this state,
including alternative teacher preparation programs, to provide
through the Public Education Information Management System the
applicable information required by Section 42.006(d), Education
Code, as amended by this Act.  Rules adopted under Section
42.006(d)(2)(B), Education Code, as added by this Act, must require
a school district to provide information linking individual
students to individual teachers beginning with:
             (1)  the 2002-2003 school year, if the district's
information is currently available in electronic form; or
             (2)  the 2007-2008 school year, if the district's
information from previous school years is not currently available
in electronic form.
       SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
