A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to sexual abuse and child molestation prevention training |
|
for certain public or private institutions of higher education |
|
employees and volunteers who work at programs for minors. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
|
amended by adding Section 51.954 to read as follows: |
|
Sec. 51.954. TRAINING REQUIRED TO OPERATE PROGRAM FOR |
|
MINORS. (a) In this section: |
|
(1) "Institution of higher education" and "private or |
|
independent institution of higher education" have the meanings |
|
assigned by Section 61.003. |
|
(2) "Minor" has the meaning assigned by Section |
|
101.003, Family Code. |
|
(3) "Program for minors" means a program operated by |
|
an institution of higher education or a private or independent |
|
institution of higher education that: |
|
(A) provides recreational, athletic, or |
|
educational activities for minors other than minors enrolled at the |
|
institution; and |
|
(B) accommodates at least five minors who attend |
|
or temporarily reside at the camp for all or part of at least four |
|
days. |
|
(b) An institution of higher education or a private or |
|
independent institution of higher education may not operate a |
|
program for minors unless each employee and volunteer of the |
|
institution who will be in contact with a participant of the program |
|
who is a minor completes a training and examination program on |
|
prevention of sexual abuse and child molestation. |
|
(c) An employee or volunteer described by Subsection (b): |
|
(1) must successfully complete the training and |
|
examination program required by Subsection (b) at least once every |
|
two years; and |
|
(2) may satisfy that requirement by completing a |
|
program approved by the Department of State Health Services under |
|
Section 141.0095, Health and Safety Code. |
|
(d) An institution of higher education or a private or |
|
independent institution of higher education that operates a program |
|
for minors must submit proof of employee and volunteer compliance |
|
with this section to the Texas Higher Education Coordinating Board. |
|
SECTION 2. This Act takes effect September 1, 2007. |
